These Terms of Service govern your access to and use of www.gummymolds.com and your purchase or use of products and services offered by Gummy Molds Ltd, including commercial gummy molds, silicone molds, custom molds, chocolate molds, prototypes, design and engineering services, recipes, standard operating procedures, consulting, and related products or services.
Throughout these Terms, “Gummy Molds,” “we,” “us,” and “our” refer to Gummy Molds Ltd. “You” and “your” refer to the visitor, customer, purchaser, business, or other person using our website or services.
By visiting our website, submitting a quote request, creating an account, placing an order, approving a custom project, or otherwise using our services, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use our website or purchase our products or services.

2. Eligibility and Authority
You must be legally capable of entering into a binding agreement to use our services or place an order.
If you place an order or submit a project on behalf of a company, organization, or other person, you represent that you have authority to bind that party to these Terms.
You may not use our website, products, or services for an unlawful, fraudulent, infringing, misleading, or unauthorized purpose.
3. Website and Account Information
You agree to provide current, complete, and accurate information when creating an account, requesting a quote, submitting project details, or placing an order.
You are responsible for:
- Maintaining the confidentiality of your account credentials;
- Restricting unauthorized access to your account;
- Providing accurate billing, shipping, contact, and project information; and
- Promptly notifying us of suspected unauthorized account activity.
We may suspend or terminate an account that contains false information, is used fraudulently, violates these Terms, or presents a security risk.
4. Product and Service Information
We make reasonable efforts to present accurate product descriptions, photographs, dimensions, cavity volumes, cavity counts, material information, production estimates, compatibility information, prices, and availability.
However:
- Product colors and appearance may vary due to lighting, photography, screens, materials, and manufacturing conditions;
- Silicone and other manufactured products may have normal dimensional, surface, color, or finish variation;
- Product specifications may be updated as designs, materials, or production methods improve;
- Production estimates and availability may change due to demand, materials, equipment, carriers, or other operational factors; and
- Website information may occasionally contain typographical, technical, pricing, or inventory errors.
We may correct errors, update information, modify products, discontinue products, or cancel an affected order. If we cancel a paid order because of our error or inability to supply the product, we will provide an appropriate refund for the canceled amount.
5. Product Selection and Intended Use
Customers are responsible for selecting products appropriate for their formulation, finished product, manufacturing process, equipment, operating conditions, sanitation program, production volume, and regulatory requirements.
Before beginning full commercial production, customers should independently evaluate and test:
- Cavity volume and finished-product weight;
- Formulation behavior and depositing temperature;
- Filling, cooling, release, and demolding performance;
- Mold support, handling, and equipment compatibility;
- Cleaning, sanitation, drying, and storage procedures;
- Finished-product quality and consistency; and
- Applicable food-contact, labeling, manufacturing, and regulatory requirements.
A reference to a material category, depositor, equipment brand, machine family, food-contact standard, or production method does not guarantee compatibility with every formulation, machine configuration, process, jurisdiction, or intended use.
Exact equipment compatibility should be confirmed using verified measurements, drawings, machine documentation, or a controlled production test.
6. Orders and Order Acceptance
Submitting an order does not guarantee acceptance. We may review, limit, refuse, or cancel an order for reasons including:
- Product or material unavailability;
- Incorrect pricing or product information;
- Suspected fraud, unauthorized payment, or account misuse;
- Shipping or legal restrictions;
- Inability to verify customer or payment information;
- Infringing, prohibited, unsafe, or unlawful custom content;
- Orders placed contrary to an applicable minimum quantity; or
- Other reasonable business or operational concerns.
An automated order confirmation acknowledges that we received your order. It does not guarantee production, fulfillment, or acceptance when additional review is required.
We may contact you for additional information before accepting or fulfilling an order.
7. Prices, Payment, and Charges
Prices are displayed in U.S. dollars unless another currency is expressly shown.
You agree to pay:
- The product or service price shown at checkout, in an invoice, or in an accepted written quotation;
- Applicable shipping charges;
- Applicable sales, use, value-added, or similar taxes;
- Customs duties, import taxes, brokerage fees, and destination-country charges; and
- Any other charges clearly disclosed before purchase.
Prices, product offerings, discounts, and promotions may change without notice. A price change does not affect an order already accepted unless the original price resulted from an obvious error.
Payment must be made using an accepted payment method. You represent that you are authorized to use the payment method provided.
8. In-Stock, Bulk, and Made-to-Order Products
In-Stock Products
Products identified as in stock may generally be purchased in the quantities available. Inventory is not reserved until the order is accepted and payment requirements are satisfied.
Bulk and Made-to-Order Products
Certain commercial gummy molds and made-to-order products require a minimum purchase quantity.
Unless the product page, cart, quotation, or invoice states otherwise, bulk made-to-order mold listings may require a minimum order of 10 molds per design.
When pricing is displayed on a per-mold basis, the customer is responsible for purchasing the stated minimum quantity. The minimum quantity, total price, production timing, and other conditions shown on the product page, cart, quotation, or invoice form part of the order.
Made-to-order products are produced after the order is accepted and may not be immediately available for shipment.
9. Custom Molds, Prototypes, and Project Services
Custom mold projects may include consultation, artwork review, three-dimensional design, engineering, prototyping, tooling, mold production, testing, revisions, or related services.
The exact scope, quantity, price, deliverables, revision allowance, production timing, shipping terms, and payment requirements for a custom project are governed by the applicable product page, quotation, invoice, project approval, or written agreement.
Project Information
You are responsible for providing complete and accurate project information, including:
- Desired shape and appearance;
- Target dimensions, cavity volume, or finished-product weight;
- Desired cavity count and mold format;
- Production and equipment requirements;
- Artwork, logos, drawings, reference images, or design files;
- Required quantities and schedule; and
- Any critical tolerance, compliance, or performance requirements.
Design Approval
You are responsible for reviewing drawings, renderings, proofs, dimensions, cavity layouts, spelling, artwork, and other approval materials before production.
Once you approve a design or specification, production may begin based on that approval. Changes requested after approval may require additional fees, revised timing, new tooling, or a separate order.
Exact tolerances, dimensions, performance requirements, or equipment-fit requirements must be agreed to in writing before production. Silicone and manufacturing processes can involve normal variation.
Prototypes and Testing
A prototype is intended to help evaluate a design or process before full production. Prototype approval does not eliminate the need for the customer to test the final mold, formulation, equipment, sanitation process, and finished product under actual operating conditions.
10. Customer Artwork and Intellectual Property Rights
You retain the rights you lawfully hold in artwork, logos, trademarks, characters, drawings, and other materials you provide to us.
By submitting materials, you represent and warrant that:
- You own the materials or have all required permissions to use them;
- Our evaluation and production of the requested project will not infringe another party’s rights;
- The materials are not unlawful, fraudulent, defamatory, deceptive, or prohibited; and
- You have authority to authorize their use for the requested project.
You grant Gummy Molds and its necessary design, engineering, manufacturing, storage, and service providers a limited, non-exclusive license to use submitted materials only as reasonably necessary to evaluate, quote, design, engineer, manufacture, deliver, support, and maintain records concerning your project.
We will not use customer artwork in public marketing solely under this limited project license unless we receive separate permission or another lawful basis applies.
We may decline or stop work on a project that we reasonably believe may infringe intellectual-property rights, violate the law, mislead consumers, or create an unacceptable business or legal risk.
11. Gummy Molds Intellectual Property
The website and its content—including text, photographs, graphics, logos, product presentations, page designs, videos, software, guides, calculators, design libraries, manufacturing methods, templates, drawings, and other materials—are owned by or licensed to Gummy Molds and are protected by applicable intellectual-property laws.
You may use the website for legitimate personal or business purchasing purposes. You may not copy, reproduce, scrape, publish, distribute, modify, reverse engineer, sell, license, or commercially exploit our content without written permission.
Purchasing a physical product does not transfer ownership of Gummy Molds’ pre-existing intellectual property, production methods, design libraries, tooling concepts, website materials, or proprietary know-how.
Ownership or permitted use of newly created custom design files, drawings, tooling, or other project deliverables is governed by the applicable written quotation or project agreement.
12. Production and Fulfillment Times
Processing, design, production, and fulfillment timelines are estimates unless expressly identified in writing as guaranteed.
Timing may be affected by:
- Order quantity and complexity;
- Customer response and approval timing;
- Artwork or specification changes;
- Material or equipment availability;
- Production workload;
- Quality-control requirements;
- Carrier delays;
- Customs processing; and
- Events outside our reasonable control.

13. Shipping and Delivery
Shipping charges and available shipping methods are generally presented at checkout or in a written quotation.
Customers are responsible for providing a complete and accurate delivery address. Costs arising from an incorrect address, refused delivery, failed delivery, customs noncompliance, or unclaimed package may be charged to the customer where permitted by law.
Carrier transit dates are estimates unless the selected service expressly provides a guaranteed commitment. Gummy Molds is not responsible for delays caused by carriers, customs authorities, weather, service interruptions, incorrect delivery scans, or other circumstances outside our reasonable control.
International customers are responsible for confirming that products may be imported into the destination country and for paying applicable duties, taxes, brokerage charges, and customs fees unless otherwise stated in writing.

14. Returns, Refunds, and Exchanges
All sales are final except when an item is verified as damaged, defective, incorrect, or when a remedy is required by applicable law.
We do not accept returns, exchanges, or refunds for change of mind, ordering the wrong product, ordering the wrong size, shape, volume, quantity, or configuration, or deciding that a product is no longer needed.
Custom molds, prototypes, design and engineering services, made-to-order molds, bulk-production orders, digital products, downloadable files, recipes, SOPs, consulting services, and used products are non-returnable and non-refundable.
If an item arrives damaged, appears defective, or differs from what you ordered, contact info@gummymolds.com within five business days of delivery. Include your order number, a description of the issue, and clear photographs of the product and packaging.
Do not return a product without written authorization.

15. Order Cancellations
In-stock orders may be canceled only when Gummy Molds confirms the cancellation in writing before fulfillment begins.
Custom, made-to-order, prototype, design, engineering, bulk-production, digital-product, recipe, SOP, and consulting orders cannot be canceled after applicable work, engineering, material procurement, production, fulfillment, or digital delivery has begun.
Approved cancellations may be subject to deductions for work completed, materials purchased, payment-processing costs, or other nonrecoverable expenses where permitted by law and disclosed in the applicable agreement.
16. Reviews, Feedback, and Other Submissions
You may submit reviews, photographs, feedback, comments, questions, or other content where the website permits.
You represent that your submission:
- Is accurate and based on a genuine experience;
- Does not infringe intellectual-property, privacy, publicity, or other rights;
- Is not defamatory, threatening, fraudulent, obscene, discriminatory, or unlawful;
- Does not contain malware, deceptive links, or unauthorized advertising; and
- Does not disclose another person’s confidential or personal information without permission.
You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute content you intentionally submit for public display, such as a product review. This license is limited to operating, promoting, and improving our business and services.
We may moderate or remove submissions that violate these Terms or applicable law.
17. Prohibited Uses
You may not use the website or services to:
- Violate any law or another person’s rights;
- Submit stolen, counterfeit, infringing, deceptive, or unauthorized designs;
- Commit fraud or provide false payment, identity, business, shipping, or project information;
- Distribute malware or interfere with website security or operation;
- Scrape, harvest, or collect information without authorization;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Impersonate another person or organization;
- Use our products or content to falsely imply affiliation, sponsorship, approval, or certification;
- Resell or exploit website services in an unauthorized manner; or
- Encourage another person to engage in prohibited conduct.
We may restrict or terminate access for a violation of these provisions.
18. Third-Party Services and Links
Our website may use or link to third-party services, including Shopify, payment providers, shipping carriers, review providers, social-media platforms, analytics services, and external websites.
Third parties operate under their own terms, policies, and practices. We do not control and are not responsible for independent third-party websites, services, availability, content, security, or actions.
Your use of a third-party service may be subject to a separate agreement between you and that provider.

Our collection and use of personal information are described in our Privacy Policy.
By using our website, you acknowledge that personal information may be processed by Shopify and other providers involved in operating the store, processing payments, fulfilling orders, providing customer service, preventing fraud, and supporting website functionality.
20. Disclaimer of Warranties
Except for any express written warranty provided by Gummy Molds or any warranty that cannot legally be excluded, the website, information, products, and services are provided on an “as available” and “as is” basis.
To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation.
We do not guarantee that:
- The website will always be uninterrupted, secure, or error-free;
- A product will work with every formulation, machine, process, or finished-product requirement;
- Production output will equal a customer’s estimate or calculation;
- Colors, dimensions, weights, or finished results will be identical in every production cycle; or
- General educational or technical information will be suitable for a customer’s particular operation.
Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.
21. Limitation of Liability
To the maximum extent permitted by law, Gummy Molds Ltd and its owners, officers, employees, contractors, suppliers, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost production, lost revenue, lost data, business interruption, replacement costs, or loss of opportunity.
To the maximum extent permitted by law, our total liability arising from a product, service, order, or project will not exceed the amount paid to Gummy Molds for the specific product, service, order, or project giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gummy Molds Ltd and its owners, officers, employees, contractors, providers, and affiliates from claims, damages, liabilities, losses, and reasonable legal expenses arising from:
- Your breach of these Terms;
- Your unlawful or unauthorized use of the website, products, or services;
- Materials, artwork, designs, or instructions you submit;
- Your infringement of another party’s rights;
- Your finished products, manufacturing operations, labeling, marketing, or regulatory compliance; or
- Your negligent, fraudulent, or willful conduct.
This section does not require indemnification for liability caused solely by Gummy Molds where such indemnification is prohibited by law.
23. Events Outside Our Control
We are not responsible for failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, civil disturbance, labor interruption, carrier disruption, customs action, government restriction, material shortage, utility outage, cyberattack, equipment failure, or transportation interruption.
When reasonably possible, we will communicate material delays and work toward an appropriate resolution.
24. Governing Law and Disputes
Except where prohibited by applicable law, these Terms and any dispute involving Gummy Molds will be governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact us at info@gummymolds.com and provide a reasonable opportunity to resolve the dispute informally.
Nothing in these Terms prevents either party from seeking relief in a court with proper jurisdiction or limits rights that cannot legally be waived.
25. Severability and Waiver
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
26. Entire Agreement
These Terms, together with the applicable product page, quotation, invoice, project approval, written agreement, Shipping Policy, Refund Policy, and Privacy Policy, form the agreement governing the applicable transaction or use of our services.
If a signed written agreement or accepted quotation expressly conflicts with these general Terms, the more specific written agreement controls for that project or transaction.
27. Changes to These Terms
We may update these Terms to reflect changes in our products, services, technology, business practices, or legal obligations.
The revised Terms will be posted on this page with an updated date. Changes apply prospectively unless otherwise required by law.
Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms.
